FACILITY USE AGREEMENT

This Facility Use Agreement is entered into on this ___ day of __________, 2025, by and between Saint George Academy, located at 380 E 3090 S, Washington, UT 84780, and Encore Performing Arts, located at 950 E. Sea Biscuit Way, Washington, UT 84780.

1. Purpose

Saint George Academy agrees to allow Encore Performing Arts to use designated facilities on the premises of Saint George Academy for rehearsals, and related activities in accordance with the terms set forth in this Agreement.

2. Dates and Times of Use

Encore shall have access to the facilities on the following dates:

**May 21, 2025 June 7, 2025 through July 15, 2025 **

Specific times of access shall be mutually agreed upon in advance between the parties.

3. Payment

Encore agrees to pay Saint George a total of Two Hundred Dollars ($200.00) for the use of the facilities for the above-listed dates. Payment shall be made in full on or before June 7, 2025.

4. Permitted Areas of Use

Encore shall limit its use of the Saint George premises to the following areas:

  • Bathrooms

  • Main meeting area

  • Entryways

Encore shall not use any other areas of the premises without prior written consent from Saint George Academy.

5. Keys and Security

Saint George Academy shall provide Encore with any necessary keys or access codes for the permitted areas. Encore agrees to:

  • Keep the keys secure and not duplicate them

  • Ensure that all doors are close and locked before leaving the facility

  • Be responsible for the replacement cost of any lost keys

6. Liability Waiver

Encore agrees to release, waive, and hold harmless Saint George Academy, its employees, board members, and agents from any and all liability for injury, loss, or damage to persons or property that may arise during Encore’s use of the facilities. This waiver applies to all participants, staff, volunteers, and attendees involved in Encore’s activities.

7. Damage and Repairs

Encore shall be responsible for any serious damage caused to the facilities during its use. Encore agrees to promptly repair or replace any such damage to the satisfaction of Saint George Academy. Normal wear and tear is exempted from this clause.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which Saint George Academy is located.

9. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any prior understandings, written or oral, relating to the subject matter herein.
